    Unhappy Lease from Previous Employer

    My question involves landlord-tenant law in the State of: Washington State

    Here is my situation. I was recently working for an apartment complex and was fired. I was allowed to stay after my termination at the apartment complex. During my employment I recieved a 20% employee discount off my rent. As part of the employment I signed a company form stating that upon my termination of employment the discount would go away. Now I ended up signing a year lease when I started working there. On my lease it states that the rent is $750 20% employee discount = $600 this is exactly how it is stated on the lease. Now upon my termination my lease was never changed and I recieved no written notice from anyone at this company. I have been paying 750 for the past 4 months. Just recently I have payed 600 to see what would happen because my lease still states I have an employee discount. Am I correct in tell the company that my rent has been $600 because no written notice of a change to my lease was ever given. Now my lease has just ended. And still I have not recieved a written notice that I am going month to month or that my rent is increasing. Please help as I am pretty sure what the law states for this matter, but I have some doubts any advice would be helpful. Thank you in advance.

    If your rent is $750, your rent is $750. I would not expect a court to give you an employee discount memorialized in your lease past the date of your termination.

    You can check to see if your lease includes any provisions for automatic renewal, or what happens once you go month-to-month. Absent something to the contrary in your lease, after it's expiration if you remain in residence paying rent on a month-to-month basis, it's a month-to-month tenancy.

    Here is an update to my previous post. Now prior to my termination I went from a full-time employee to a part-time employee. When that happened they terminated my employee discount. Now my lease still to this date which ended in October states that my Rent is $750.00 20% employee discount = $600.00. Now according to the lease it states that any changes/adjustments to this lease with be done in writing in accordance with Wash. Law. Being:

    Rent Increase

    If there is a lease for a specified period of time, the rules of the tenancy, including the rent, may not be changed during that period. In the case of a periodic tenancy (such as month-to-month rental agreement), the rules, including the rent, may be changed upon 30 days' written notice. Rent increases cannot be in retaliation for the tenant's assertion of his or her lawful rights. The landlord may charge a late payment fee if the rental agreement expressly provides for the charging of a late fee.

    No written notice was ever give to me and none exists in my file. For the months of October and Nov. when I paid $600.00 my rent was received and accepted by this company and I have receipts for those payments. This company has a no partial payment acceptance policy. My payments for those months were not returned to me.

    Now I understand the month-to-month tenancy and I am not in disagreement with that, my issue is what is my rent amount? I have never received a rental increase from them in writing per wa law when they terminated my empl. discount. Also I never received anything from them in writing telling me to come in and sign a new lease. I've have worked in housing for 2 years for a different company in this state and they followed the law to the letter which I am greatful for, this company shows very little regard for there own procedure and the law. Any advice would be helpful thank you very much.

    This is a situation I have yet to come across. I will give you my best guess.

    I believe that you should continue paying the discounted rent WITH THE CAVEAT that IF they take you to court for non-payment of rent (which is what will happen), you can present your case to the judge to see what they say.

    Be prepared to state your case AND still possibly lose. If you do, you will have to pay the back rent balance + late fees and possibly attorney fees also.

    It is a gamble, but possibly worth it.
