    Default Diversion possible? First time offense - Retail fraud

    How likely am I going to get the judge to offer me a pretrial diversion in my circumstances?

    -First time offender
    -Totally clean record
    -Retail fraud: approx $100
    -Non-violent
    -Co-operated completely with police and LP employees
    -Sent out a letter of apology to the store
    -Offered to pay the store for what I tried to defraud them of

    Also, do I need a lawyer if I don't plan on going to trial? Will hiring one change anything?

    A local lawyer (or possibly the court) can inform you of diversion programs available in your area. If such programs are available, you would likely be a good candidate.
