    Question Ex-Boyfriend Threatening to Petition for Paternity

    My question involves paternity law for the State of: TN
    My baby is still in the womb and I'm not due until Feb. 09 and my exboyfriend says he's petitioning for paternity. How can this be when the baby isn't even born yet?

    well, he goes to the court and files the appropriate paperwork.


    I bet that isn't what you meant, is it?

    So, he can, and should file, if possible (it isn't possible to file until the birth in some states). A potential father would do that so you cannot take any actions to leave the area with the child, give the child up for adoption, or put another mans name on the birth certificate.

    why would you argue about such an action? At least he is not simply telling you it isn't his and walking away.

    I would do that because he hasn't stopped harassing me since we broke up. I'm living with my parents now and we have told him to stop trying to contact us until the baby is born. He continues to call, leave messages, and even texting my mother and saying ugly things to her. He is contacting my friends and telling them lies about me. He is a bad influence and hangs out with people who do drugs.

    TN is one of the states that allows the putative father to register before the birth to ensure he is on record that he want to know if the child is his.

    The Putative Father Registry is kept by the Tennessee Department of Children’s Services.

    IF the father is threatening violence against you and/or your family you should see about getting a restraining order. If he is harassing you ILLEGALLY then you should see about taking civil legal action.

    If he is only trying to enforce his rights as the father of the pending child - you need figure out how to deal with him for the next 18 years.

    well, you made the decision to sleep with him. Calling him a bad influence now is kind of one of those "you should have thought of that before" issues.


    Concerning the parentage action: you don't worry about it as it is his right


    to the harassment: you make police reports and it sounds like a restraining or protective order would be proper.

    but I've hear that restraining orders are not enforceable and protective orders are only if physical threats have been made.

    thank you, I am seeking legal counseling next week. I'll post updates.

    generally speaking, PO's are when there have been threats and RO's can be enforceable, depending on the situation.

    Sometimes simply filing for one and having the other party having to show up in court to defend against why you filed for one wakes them up and lets them know you are not simply going to roll over and allow them to do what they are trying.

    Okay, thank you. I spoke to a law enforcement member today and he informed me that RO's are not enforceable, but I do have an appt with an attorney next week.
