My question involves landlord-tenant law in the State of: California
I have a guy here who signed a sublease for a room under me and another friend (we have our names on the main lease). The sublease starts December 1st, but since he really needed a place to stay prior, I let him have the living room and gave him the key about 6 days before actual lease date.
Rent is due December 1st-5th, as is his share of the deposit. He's been putting things off and finding excuses to not pay - just generally avoiding the whole issue. He would not sign a roommate agreement form that I drafted. In addition, the sublease has NOT been signed by the manager yet. At the bottom of the sublease, it states in bold and caps "THIS IS NOT A VALID CONTACT UNLESS APPROVED BY THE OWNER OR AGENT."
Basically, this guy's in the house with the key but not legal at all. I want him out - as he has been making a huge mess around the house - not throwing out trash, not washing dishes of MINE that he uses, etc.
What can my friend and I do in this situation? I realize that it's our fault for letting him in before manager approval...but we would like to know what we can do to protect ourselves, our belonging, and our place...and we want this guy out ASAP! He's currently living in the room downstairs of our 3/2 townhouse, while my friend and I live upstairs...I've already moved most of the valuable belongings into my room, and all that's left downstairs is a T.V., the fridge, food, and some cooking/dining utensils.
