Default Adding My Last Name to My Son's Name

My question involves name change laws in the State of: WV

I was hoping that someone may be able to help me figure out if my son could have my last name added to his? My ex-boyfriend and I have a 3 year old together and he has my ex's last name. His father is on the birth certificate & pays child support, however I am the primary caregiver. I know that the only way I could change my son's last name to mine would be with the consent of his father, so is it possible for me to add my last name to the end of his to make it Kirby-Goodman ( Kirby his orignal, dad's last name, & goodman being mine). My ex and i were never married if that matters. If this is possible what would i have to do?

    Thanks!
    Amanda

From what I've read, you'd need the biological fathers consent. If he agrees, you both sign and then file a motion with the courts for a name change.
