    Default I Was Speeding but I Think I Have a Good Enough Reason

    so i got a speeding ticket the other day, VC 22349 (A) UC exceeding maximum speed limit. the police officer told me i was going about 85 mph but wrote on the ticket 75 mph. i was driving down on the freeway in california. i was in the fast lane, the guy driving behind me was far away at one point when i looked in the rear view mirror. when i looked again behind me he was getting really close to me at excessive speeds, there were a few cars next to me on the right lane, and since i was in the fast lane i sped up the car and once i past the cars to my right i made a lane change to the right while the guy behind me drove off. next thing i know a police officer is pulling me over. i told the officer the same story, but he just told me that i was speeding and wrote me the ticket. on the ticket it doesn't state how he got my speed, no where on the ticket is marked as to radar, or laser, or pacing. but the officer did mention that he did pace me to get my speed. is there any way of getting off of this ticket, the guy behind me should have gotten a reckless driving ticket and instead i got the ticket. there is a possibility that he might have hit me if i didn't speed up. any help would be wonderful

    Consult with an attorney. Bottom line is that you were speeding and admitted such; no matter the circumstance (with the exception of a bonafide emergency and even then it's iffy). You were the one ticketed and now must either pay, defend yourself or hire an attorney to do so.

    Sorry to say, you're going to have a tough time convincing the judge you were justified.

    It doesn't sound like a "good enough reason" at all... In fact, if the officer "paced" you, that would suggest that he was behind you for a while, which might also suggest that he would have seen the tailgater/the person driving recklessly. Don't you think?

    Good point! Even more damaging to his case.

    Consider the officer's view of the events - he may well have noticed you only after the other car was tailgating you and thought you were setting the pace with the other car simply following in your wake (and getting a lucky break), and he pulled you over for being the first.

    You can always try to argue that the officer didn't see the entire sequence of events and maybe you might get a fine reduction, but unfortunately your chances of getting a dismissal on those grounds are nearly nil.

    If "my wife is in labor and we're on the way to the hospital" isn't enough for a dismissal, "I had a tailgater" DEFINITELY won't be.
