    Default Second degree assault downgraded to disorderly conduct

    Just a question?? I have recently been charged with a 2nd degree asult. What has happened is I went over to the house where my sister inlaw was living with her boyfreind. And got into an argument with her boyfreind about him having her live in a known meth house cause I didnt want her around that enviroment. I never touched him or threatened his person, in the end all I did was tell him that if she was still there in a few days I would turn him and his place in for all the drugs that are there. Well the next day I was arested at work by four officers who said I was charged with a 2nd degree. The boyfreind had gotten three of his buddys together and they called the cops and told them that I had threatened them with a handgun. I let the cops serch my house and truck and obiously they found no gun cause there wasnt one to begin with.. I still spent sat, sun, and most of monday in jail and got released. Now my public defender said that the prosecuter may offer a pleabargain for a disorderly conduct instead of the 2nd degree. Should I take this to avoid the whole drug out trial and trying to prove my word against 4 druggies or fight it? What could I get for disorderly, it is my first offense ecept for a few speeding tickets? Oh by the way I live in Minnesota.

    If they were lying about your having a gun, they won't have much credibility in court. Will your sister testify that you did not have a gun? That these people are involved in drugs? Are there any police reports relating to prior incidents at the house which might support your contentions, given your assertion that it is a drug house?

    No my sister inlaw wont testify for me because she is now mad at me because of the ordeal. All the people who made the reports have prior drug convicions or are known in the area to either be makers and or users. The thing that wories me is one of them is a narc he escaped a jail sentance for roling over on some other dealers in the area.
