    Default Utility Wires Damaged on Easement of My Property

    I need to know what responsibility I have for phone company wires on the easement on my property in the alley. The cover for the wires disappeared months ago and my neighbor, whose lawn abuts the utility box seems to have mowed through the wires. The phone company has filed a substantial claim against me for my negligence. This is in Texas. Thank you.

    whoever damaged the wires is responsible for the cost to repair them. If that person cannot be determined, then the phone company eats the cost.

    If they are after you for the costs to repair, they must believe you caused the damage.

    I can't quite figure out how one would mow wires that are within a phone pedestal though.

    thank you for answering. The utility box covering the wires was gone. It's our guess that the garbage truck hit it in the alley. They are always going up over the curb.
