    Default 17 and Wish to Be Emancipated

    My question involves emancipation laws for the State of: Florida

    I'm a 17yr old female, looking to be emancipated, but have no idea as to how I would go about it. I know that a steady job and proof of being able to take care of myself would help tremendously, but unfortunately I have no job, and no way to support myself on my own. The only way out I have is my aunt who lives all the way in Canton, Ohio.
    My parents have been divorced a little over ten years now. After the divorce I lived with my father up until I was about fifteen. My father was a chronic alcoholic and I went through physical, but more so mental abuse. After too many fights, my father decided it would not be best I live with him, and sent me to live with my mother. In this house, I have to share a bedroom with my 15yr old step sister. Two more of my siblings live in the same house. My stepfather is a very needy, yet controlling man, and my mother is truly unhappy. But because she is afraid of him, she takes the anger out on us children. My mother tries to be that "best friend parent" one minute, then will be the most.. livid human being the next. Her insane mood swings really take a toll on my siblings and I. I have a five year old brother and 8 year old sister who constantly have to deal with her screaming and cursing at them. My mother and I have been in one physical dispute in the two years that I've been here, but she has threatened physical abuse more than I could tell you. All I want is to get out and be happy, and I feel as though she is constantly holding me down.

    If you have any feedback it would be more than appreciated. I truly am stuck and feel I have no other options left.

    Being emancipated means you support yourself 100%. If you want to go live with your aunt - ask your mom to send you to Ohio. Your mom can give your aunt limited power of attorney so she can enroll you in school and take care of medical and legal stuff. If your mom does not want you to leave then you are stuck until you're 18.

    That's the thing. It seems as though waiting just.. wont work. I've applied for jobs in numerous places, but with the economy being how it is, almost everyone has lost their jobs, or is having trouble finding one. I cannot begin to tell you how determined I am to try and get out of here and better myself.

    Even with the complete and utter approval of your parents, there is no court in Florida that is going to emancipate you without having DOCUMENTATION that you have held a job for AT LEAST 4 to 6 months, AND that job pays you enough to cover ALL of your living expenses, including health insurance. There is simply ZERO chance that emancipation could occur until you've held a solid job AT LEAST that long. That's the EASY part. You'd still have to deal with the difficult side of things that the court will look at. Without parental approval to do otherwise, legally, you are stuck with your parents.

    Not to mention the fact that in Florida, unless YOUR PARENTS will file the petition for emancipation, you're dead in the water before you even start.

    You CANNOT be emancipated if you cannot support yourself. Living with your aunt is NOT emancipation.

    That's what I figured. I'm just trying to get more information on it before I decide to take the action to actually do it, ya know?
