My question involves an auto loan or repossession in the State of: SC
so me and an ex friend of mine entered into a verbal contract in SC. I placed a vehicle in my name for her in early 2008, and she agreed to pay and carry the insurance. she paid for 5 month some late and paid a few more times here and there because she ran into some financial troubles on her own accord... eventually she finally stopped paying all together and pretty much is trying to run from me by not answering my phone call etc... i have plenty of emails between me and her were she is stating that she will"pay the car note this month" and "pay me back every penny" and so forth...
Eventually because she would not pay... and I simply could not pay the car note, i voluntarily had the car repo'ed in Aug 08. I checked my credit and the financier wrote off the vehicle for 8,000, when 10,000 is orginally owed on the sold vehicle...
Can I sue her for breach of contract with all the written evidence (emails/text messages) I have to prove we had a contract together?
