    Default Emancipation

    So I'm 16 and currently living in Virginia. I have not really had much of a father growing up because he was in to drugs and alcohol and also in and out of jail. My mother was in prison from the time I was 4 to 8. I've been through alot in my life and I think its best if I got emancipated, but I know my mom will NOT sign the consent form. I don't know what 2 do. She likes to smother me and she is really disrespectful. My mom and I really don't get along and we are constantly fussing or fighting. Sometimes it even gets phyical to the point I go to school with black eyes. I love her and I know that I only get one mother but I'm tired of being talked down to and striked.I do most of everything I am asked to do, but as much as I try nothing is good enough for her. I KNOW how to take care and support myself. I have the basic knowlege of what I have to do but I just dont know where to go or if anyone will help me to do so. Well if you have any information on the Emancipation Law please send me a note.

    The last time that it really got bad css (child social services) got into it and we went to court and a would get mothly vistits from css but she got married and then moved to a different county. now that were in a new county there is nothing they can do about what happened where we use to live. Anyways my councler was concerned and so was one of my teachers but thats about it. Where i live now noone really pays much attention because theres alot of other kids and alot of them are either fighting or doin drugs somewhere i dont think it really matters.

    Whoever at CSS that told you that they can't do anything because your moved to another county is wrong and should be disciplined or fired.

    Call this number (800) 552-7096 - let them know your mom is still abusing you!
    It does matter - it really does. Your school is also required by law to contact the authorities on your behalf. If they won't then you need to.

    So we fight no big deal, i know when she hit me i hit her back. I kno this sounds bad but i dont know!We fought like you would fight someone outside, but lets not get off topic. i dont want to hurt my mom she already says that she going to go crazy and needs to be put in the "lunnyben at tuckers" nd i dont want her to get into anymore trouble with the law.

    so i really need so help. can anyone please give me something else besides calling social services or saying that im getting abused because thats not helpful.

    Honestly - if you're wise beyond your years - you should have been able to search the sticky thread at the top of the forum...

    "Quoting Virginia Code § 16.1-331. Petition for emancipation.
    Any minor who has reached his sixteenth birthday and is residing in this Commonwealth, or any parent or guardian of such minor, may petition the juvenile and domestic relations district court for the county or city in which either the minor or his parents or guardian resides for a determination that the minor named in the petition be emancipated. The petition shall contain, in addition to the information required by § 16.1-262, the gender of the minor and, if the petitioner is not the minor, the name of the petitioner and the relationship of the petitioner to the minor."

    It's your only option.

    No judge in the nation is going to emancipate you without proof that you are doing a better job of taking care of yourself than your parents.

    Operative words being "are doing". Not "can do" or "will do", but "are doing" - as in, you've been working full time, managing all of your finances, staying in school and keeping good grades, and already living apart from your parents.
