    Exclamation Abusive Parent Threatens to Take Child

    I don't know what to do about this situation. Our son is 4 and is very attached to both of us. We live in FL all together, I have been trying to make it work, but his mother has anxiety and anger issues. She gets enraged over everything she doesn't like. She has broken many things even my computer, she's even threatened me with a knife in front of our son. If I call the police it will just makes things work out bad for me and my son. I could be on the floor with two black eyes and still be the one to go to jail and lose everything. This is just a bad situation for us all. I want peace though. Problem is she has full legal and physical custody rights in CA court order. I only have visitation 3 times a week. That's what happened when I went to court for this problem. She lies and complains to the mediator and I get the shaft when I tell my side. Anyway we have a 1 year lease together on this house. Both of us signed it. She threatens to leave to a friends house in CA. I don't want our son to go through that. I have been taking pictures and logging the outbursts by sending my mother emails now. I'm thinking of telling her that I am going to video or record her from now on just before she starts a rage. I do not want to have to get any authorities in on this problem because I know how damaging it is. If you have some advice on what I can do to get 50/50 legal and physical custody at least, please advise! I have a fixed disability income only, on SSDI and I am my sons payee for his SSDI. Thank you!

    You have to file for it and wait for the court's decision. There's no magic bullet here.

    Your best option is to seek out counsel. Given that you're on a fixed income, you might contact Legal Aid in your area for assistance or a referral to an attorney who can work with you for a low fee.

    I would like a detailed answer for direction in my situation here. it is very important for my young boy to have both his parents in the picture. im considering doing nothing at all because the system is soo harsh with dads. but his momma is just too abusive to me, i don't know what to do.

    That's not going to happen here. For details appropriate to your situation, you need to speak with an attorney about filing for a modification of custody.
