    Default Hydroplaned into Median in New Jersey

    My question involves a careless driving ticket from the State of: NJ

    I was driving home from college for break on a rainy day. I was going 55 in the left lane on a 3-lane highway with a 65 speed limit (no other cars around in the left lane). I was in the left lane to avoid trucks barreling down the highway in the right lane that were spraying water on my windshield making it hard(er) to see.

    I started hydroplaning and hit the median. I wasn't going fast enough for airbags to inflate and both me and the passenger in my car were fine. No other cars were involved.

    I need to get this ticket dropped or my license will be suspended for 6 months due to probation from getting 6 points in my first year of driving. What do you think I should do, and do you think it will be easy to fight?

    Well, thank God you and your passengar are alright - that's what counts the most.

    You were cited for unsafe or reckless driving (something to that affect). No matter the posted speed limit, you should never drive at speeds that could put you, or others, at risk; be it 55 in a 65 or 30 in a 45. If you hydroplaned, the arguement would be had that you exceeded the speed limit based on the weather and road conditions at the time and should have known such. Speed limits are set with ideal conditions in mind (no rain, fog, excessive wind, snow, etc.) for the area.

    Also, having 6 points against you prior to this ticket will not likely sit well with the judge. It will most likely show to him/her a serious lack of judgment and disregard for the rules of the road.

    Consult an attorney in your area who specializes in traffic law to see what, if any options, are available to you.

    Thank you, we really are lucky to have come out without a scratch, especially considering the road this happened on. I don't even want to think about what would have happened if a truck was behind us.

    I have 0 points on my license now, but I see what you are saying. That 6 points in my first year was 3-4 years ago and I haven't gotten a ticket since. I took the drivers class last spring for it due to it conflicting with classes, and my 1 year probation started then. Will the judge see my complete record, or will he just see what I have now?

    I'll be honest, I was pretty optimistic about getting this ticket dropped, but the way you are sounding I'll be hard put to even get it reduced.
