    Default Florida Statute of Limitations on Credit Card Debt

    My question involves collection proceedings in the State of: Florida. I was contacted today by a creditor regarding a bank issued credit card from NY with last activity in 2001. After the guy told me what a bad person I was and how much moral conviction I lacked, he asked if I was "going to take care of this problem today?" I answered no and he mentioned my moral fortitude AGAIN (is this necessary?) then ended the call. What exactly IS the sol on credit card debt, what can they do after 8 years, and shouldn't this have "magically" gone away by now?

    Florida; 5 years as a standard on revolving accounts. However, for educational loans, there is no SOL

    If in doubt, contact an attorney in your state for specifics.

    It's up to each court - some 4, some 5 One court that said 4 was Palm Beach County - PORTFOLIO RECOVERY ASSOCIATES, LLC, v PAUL FERNANDES
    A person really needs to contact an attorney in their area of Fl. to see how courts in their area are handling the SOL currently on credit cards.

    However, you note that 8 years have elapsed since you pd. on your card.

    It's probably a junk debt buyer trying to sucker you into paying on an expired debt. If you do, in most states the payment will renew the debt and allow them to pursue the entire balance through the courts.

    Agree, definitely don't pay anything on the debt - it will most likely restart the SOL which seems to have elapsed in your case.
