    Default Multiple Employers During a Base Period

    I am in California.

    I have 2 employers that fall into my base period. The first one is where I made the highest wages, but I voluntarily quit. The second most recent employer is a job I will loose due to lack of work which makes me eligible for unemployment.

    My question is will my first employer count towards unemployment benefits amounts even though I voluntarily quit that job since my second most recent employer is laying me off.

    your base period is your base period...period.


    If you have not been employed at the most recent employer for long enough, you may have a problem qualifying for UI but the UI office will make that determination in line with your states laws and rules.

    All earnings from all employer in the base period are considered for the financial eligibility of your claim. However, employer #1 CAN protest your claim, since they are in the base period.

    Yes, it will count.

    When you say "my second most recent employer is laying me off", I think you mean your "most recent employer."

    And, for qualifying for unemployment, it should not hurt you that you left this job voluntarily. There is nothing wrong, for UI purposes, with leaving a job to take another job. There is not even a place on the form to report why you left any but the most recent job. You are required to report all employers for which you worked in the past 18 months.

    I know states can be different but I can tell you that I quit a temp-only assignment before it was completed for a temp-to-hire where I got let go after three weeks. Employer #1 protested, I appealed twice, and lost. (This was Maryland at the time.) They said I didn't have "good reason associated with the work" to quit assignment #1.

    that was why I stated what I stated. In the couple states I deal with, if you quit a job and do not work for the next employer long enough, you will be DQ'd for some period of time.

    that is why, like always, the only real response is:

    file for UI and the state will apply the applicable laws and make their determination.

    Yes, nothing is guaranteed, which is why I said "should not hurt you" rather than "will not hurt you".

    In this case, since the OP stated that both the previous and current employer (from whom he expects to receive a layoff) are in his base period, he has worked for the current employer since June 30 or longer. My opinion is that would be a sufficient period of employment since the resignation, so that EDD would not be concerned with the resignation. I would really be surprised if EDD makes an issue of it regardless of what the earlier employer says.

    But, as you say, file and find out. It wouldn't be the first time in my life that I've been surprised.

    Thanks again everyone! I will keep you guys posted. I am going to try to ask EDD directly and also talk to a lawyer.



    I also found that you can get free help from the legal aid society. They also have a ton of fact sheets which may help a lot of people on this board. What do you guys think?
