Default Fence Property Line Trespass in King County, Washington

My question involves personal property located in the State of: WA

Neighbor has fixed their own fence 5 inches back into their property line than on Property line.
Now it looks like those 5 inches on in our property line. When we have a planting bed for 10 ft from the fence there was dirt filled in that area.
Now they are calling it as criminal trespass in the second degree.

Fixing the fence on the property line should be legal so we dont go thru this.
    Appreciate your feedback

Who are calling it "criminal trespass in the second degree"? Are you telling us that you're facing criminal charges?
