Hello. I am new to the site, so please bear with me. I have been reviewing the threads, before I decided to post just for any guidance. Here is my problem:
My boyfriend went to the US Embassy in London for his interview. He turned in his application, and passport as instructed. The gentleman then told him he would receive his passport in 3 business days and that he was done and to go to the courier's desk to pay. The courier asked if he was approved for the visa, and my bf said "I guess", and the courier took his issuance fee. My bf received his passport back 3 days later with a stamp/sticker on it.
Because the procedure was not what we expected, he called the Embassy who said that he was not issued a visa because he was not interviewed.
He rescheduled an appt and was seen again. He was asked 4 questions: why did he want to stay for 6mos; how did we meet; was he employed; and how was the trip financed. The officer removed the sticker from the passport, placed a new one on, and gave it back. She also told him he did not have to pay the fee (issuance).
Now, my bf is 21; was employed during the time he was hit by a car, so is currently unemployed now; he met me on a dating site;and he lives with his father. He stated that I would finance the trip. She also asked why he wanted to stay for 6mos, and he told her that he wanted to see american culture and that the only time he would be able to was on the weekends since I and his US friends work. The consular denied his visa because she was not convinced. I know how the situation looks with all of the factors, but he gave truthful answers.
So, what I would like to know is if he should even bother retrying again because he has ties for his return to London. He has a pending insurance claim because of the accident; he has hospital visits for his injured hip; and he has to care for his father who is on disability (my bf's parents are divorced and his older sister has a child,apt, and job that she will only be able to check in quickly with their father). He did not inform the officer of these as he was waiting to be asked about ties (we are both new to the process).
Are these ties possibly strong enough to convince the officer of his return?
He cannot enter on the VWP, because we miscalculated his stay by 2 days and it does not help that the Immigration officer stamped the wrong date on his passport when he arrived on the VWP.
If he cannot, what other options do we have as we just wanted to visit and have no intentions of marrying during this time.
