Ok so this is all hypothetical of course. Say a guy got into an argument with a girl he was dating over the phone. The guy was in a completely different town hanging out at a friend's house at the time. The guy is somewhat under the influence of drugs. The girl tells the guy that she will "come find him", and "put him on a list", and the purpose of said list is not revealed immediately (later on it is revealed it is a list of people she needs to stay away from).
Girl knows that guy is under the influence, and says that she is going to call the police and report that he is. Guy has been attempting to diffuse the situation by telling the girl he will call her tomorrow to talk. Girl refuses to let him hang up and talk tomorrow. Guy feels that girl is harassing and attempting to stalk him. Finally guy hangs up and turns phone off.
When he gets home, guy stops at his house for 5 mins then leaves to pick up another friend to go hang out at a friend's apartment. On his way to the front door to leave, guy spots girl's car slowly driving down the street away from his house. Guy recalls hearing about how girl was involved in certain domestic argument situations with her ex-bf, and that she keyed ef-bf's car. Guy decides it has gone too far and feels like he is being stalked and also fears for his property being damaged.
Guy goes to police station and speaks to an officer. He tells the officer that the girl "was going to come find him", "would put him on a list", and that the girl was spotted outside his house earlier. Guy also stated that girl threatened to call the cops saying he was under the influence of drugs, which he was not (he was earlier, and just told the officer he was not). Guy stated more than once that he did not want to press any charges, and that it was merely insurance in case something did happen, knowing girl's history. He also stated that it was to be known that he did not fear for his safety at all, and was only worried for the safety of his property. The Officer wrote out the report, and did not ask the guy to sign or write anything, only asked for the name, addresses, and phone # of the respective parties involved. Guy did not know exact house number of the girl, and officer spelled girl's last name incorrectly as well.
It was later discovered that the girl was not acting psychotic, and is just very stubborn. She was apparently worried for guy's safety and she was never going to go through with calling the cops like she said she would. It was revealed that girl stopped by guys house because she wanted to talk and guy was not picking up his phone for girl.
Girl obtained a copy of the report filed and feels that it needs to be lifted because parts of it are false and she feels it may affect her negatively. Guy realizes he over-reacted during said situation and calls police department to find out if report can be lifted. Guy is told by desk clerk and by officer that report is permanent and cannot be lifted. Girl wants guy to admit to filing a false report to get it removed (not sure if it can be in that situation???)
Things on report that are false:
- Girl is ex-gf (they were only dating for 8 months, practically bf and gf but did not have official title)
- Girl did not reveal purpose of "the list" (she later said on phone that it was for people she needed to stay away from)
- Guy was not under influence of drugs and for any claim girl could later make regarding this, officer wrote that "her claim is baseless". (guy was slightly under the influence, not to the point of being physically affected, but possible change in perception or judgement was possible)
Questions:
1. If it is stated by guy that report was somewhat false, would the report be erased?
2. What type of trouble would guy get into by stating this?
