    Default L-1a to Green Card Processsing

    I am a Software Professional working as a Contractor for a Health Care Insurance company. I have been in the USA for more than 3.5 years now and hold a L-1B visa. I tried initiating Green Card processing through my Employer and they said they would be placing me in EB3 Category.

    I am transferring to L1-A visa this January as I hold a manger position and heard that L-1A Holders are eligible for EB1 category since they hold a manegerial position. However, my Employer denies that and they say they would continue to have me on EB3 Catergory.

    I have not yet initiated my Green Card processing as I have the below quesitons. It would be great if you can answer them

    1) Is it true that holding a L-1A Visa will place me in EB1 Category.
    2) Can I process Green Card through a law firm. or another consultant company? If yes, is that going to affect my current job with my Employer? What are the pros and cons of doing this.

    Please help me in understanding this process and I would make a decision based on your answer.

    YOU may not process for a green card. An employer must petition on your behalf when you are using employment as the basis for filing. You need to review the information on the USCIS website.

    How can you be on L1B and be working as a contractor? Are you not working for your L1B sponsoring employer?

    Hi,

    Yes. I am working for a L1B sponsored Employer.

    So, does this mean that I can file GC only through my Employer?

    Hi,
    1) It is true- being approved for a L-1A Visa/Status you will be eligible for Green Card in EB1 Category.
    2) Your Employer will have to sign application and a cover letter describing your managerial position and explaining the permanent need for such a manager. It means you can file GC only through your Employer.
    Do you receive W-2 or 1099 type compensation?
