    Default 13 Year Old Outstanding Warrant for Probation Violation in Texas

    My question involves an arrest warrant from the State of: Texas

    I had a drug problem in my teenage years and early 20s and was travelling in Texas from California and got arrested for Possesion of Heroin 3rd Degree felony. I ended up getting 5 years probation and had it transferred to California. I had to pay court costs to Texas and contact my Texas P.O every month. After just under 2 years California's Probation Dept contacted me and let me know they were sending all my paperwork back to Texas and reccomending I get early release for compliance. Texas was angry. I was behind payments I think. I might have missed a month reporting so Texas sent me a court date for violation. I couldn't drop everything and go to Texas so I never made the court date.

    I seem to have an outstanding Warrant for Probation Violation in that county of Texas but it's never shown up on any of my more recent Jail terms I had served since in California. Neither on any routine traffic stops or subsequent Warrant checks. My Texas PO at the time even told me if I ever came back to Texas I would be arrested but it might not show up here.

    My problem is that I'm planning on leaving the country to attend school. I've successfully got a new Passport already but I'm kind of worried when coming back the outstanding Warrant may show up. What kind of Warrant checks do they do when your in Jail? How come it's never popped up? From what I understand Outstanding warrants have instruction for Officers to follow when it pops up. Is it possible that it has instructions only to pick me up in the state of TEXAS? They know exactly where i live. It's not like I'm hiding or anything.

    I even thought maybe I could go to school overseas and then when I came back let them pick me up at the border for the free transportation back to Texas. I do want to take care of it. If needed. I just have no other reason to go to Texas ever so i thought it wouldn't ever be a problem. I'm a little worried on what kind of sentence I would receive. Is it possible they could re-instate my probation along with a Jail sentence? Or Prison? If I had an idea on what type of Sentence I am looking at upon return It would make me feel much better, just so I know what to expect upon my return to the Texas courts. I have 5 years clean from Drugs and have straightened my life out. I'm hoping that would count for something.. Any advice would be greatly appreciated.

    Warrants never expire, that is until you're arrested or pass away. Why it 'never' showed up is not the issue as you could be arrested at any moment.

    You need to consult with a criminal defense attorney and determine your best route in order to take care of this. If you delay and are subsequently arrested, you could sit in jail until your trail date, which could be months. If convicted you could be sentenced to jail time, fines, probation, etc.

    As far as reinstating your probation, that will be up to the prosecuting attorney and your attorney to craft a plea deal; and for the judge to accept. However, the longer you delay, the slimmer a favorable plea deal exists.

    Consult with an attorney immediately and get this taken care of. You'll definitely sleep better.

    Thanks. I consulted a Texas attorney and gave him the Warrant Number and he checked it out and he seems to think there is a good chance I could possibly be granted bond for the Probation Violation if he could get a judge to agree and I'd just have to go back to Texas and do a "Walk Through" at central booking in which I would be booked and released. After that hopefully I'd get my court date that day or the next regarding the violation. Without any guarantees he says I'll probably get the probation terminated "Unsuccessfully" for the record and be done with it without serving any jail time.

    I'm probably gonna hire the lawyer and try to take care of this soon. It's probably a much better idea then waiting to be apprehended at the border upon return. Hopefully I can still go to school overseas next fall as long as they don't decide to extend the probation. He said there's a slim chance that could happen. I'm gonna bring letters from my employer and people I work with attesting to my new life. It's been over 5 years since I've been in any trouble what so ever. Hopefully that will help.
