    Default How Do I Know if I Would Have a Civil Demand

    My question involves criminal law for the state of:
    I ended up being accused from shoplifting in a Whole Foods store in Illinois for putting a wrong tag on a piece of cheese that was more expensive, it was a stupid and careless thing to do but anyways after I paid everything at the register they stopped me and brought me to a room with the resposible of the theft department and the guard of the store.They asked me questions and asked me to admit that it was me who stick the tag on that cheese. I admited and they took a picture of me and a copy of my ID and asked me to sign a form in which I agreed in not coming back to any Whole Foods store and they asked me to pay the $4 dollar difference of the item.

    The police was not involved and they didn't mention anything about civil demands or fines, they just asked me to leave and promise that I would never do it again. But now I am freaking out because I have been reading all these cases about fines and attorneys, etc. If they didn't mention anything about civil demands is it possible that I get one?I didn't get any copy of anything either. Please help. I am scared, I have never stole anything in my life I didn't mean to do so..

    As the police were involved, you can expect a court date to arrive in the mail. You may want to get a free consultation with a Criminal Defense Attorney.

    If you don't see an attorney, plead "I stand mute" and ask for a Public Defender.

    Yes, you will see court fines and costs.

    Do expect a Civil Demand letter.

    The police were NOT involved at all. They didn't call the police. I asked if I had to pay anything else and they said:no. Just don't do it again.

    I guess my question is if they didn't let me know anything about a civil demand and I didn't sign any "green" paper requiring any fine and therefore I haven't any receit with me, should I still expect a civil demand on the mail?

    I only signed the form banning me from trespassing their property and in the same form there was the price difference of the price tag which was around $5
    I paid the difference and they let me go. (NO police involved).

    (I really didnt mean to steal anything, I didn't take anything without paying, I just put the wrong price on the item!) I am really upset about it, I cant believe it.

    You don't have to sign anything agreeing to a civil demand. If they're going to send you one, you don't get a choice in the matter - you either pay it when it arrives, or face both civil and criminal prosecution.

    Typically, you'll be told to expect a civil demand. Whole Foods has told you that you're done, so stop panicking and let this be a lesson learned.

    Price tag switching is still theft. "Accidentally" switching a price tag is still theft.

    If you should find something unpriced in the future, your best course of action s to ask the nearest clerk for help.
