    Default Shoplifted at Walmart

    My question involves criminal law for the state of: California

    I need help because I'm very scared after reading other people's thread on this site.

    My situation: I'm 23 and stupidly decided to steal a $9.99 measuring tape at Kmart (Riverside,ca). This is my first time doing it. I was caught and gave my information. The manager said that they will send a civil demand for the crime and I'm ban.

    If I pay the fine will they take me to court? I don't have money and no job, so how do I obtain a lawyer if I do go to court? PLZ help.

    Sorry when I mean court, I want to know if they will take me to court to charge me for the crime?

    I would like to include that no cop was called out.
    Does that mean the cop can file a case on me since he didn't come out?

    What is the usual punishment that Kmart in California give to first timers who are over the age of 18 and the item in question is less than $10.

    Please help!!!! I thank you for any comment that will answer my question.

    Not usually. They do have have a year to bring you up on charges, but generally, if you pay the civil demand - which will be a MINIMUM of $100 - that's the end of it.

    I don't have money and no job, so how do I obtain a lawyer if I do go to court?
    You plead Not Guilty at your arraignment and ask for a Public Defender.

    Also had a question about the national retail database.

    Does anyone know exact if other jobs that are not in retail (like resturants and cafes) run a background in the NRD? I also want to know if office jobs (local, private, and government) will also run a background in the NRD?

    And how about school because I was hoping to go back to school for either pharmacy or law (not sure) and was wondering does shoplifting in the NRD effect my chances in getting in?

    I know I was pretty stupid what I did, but if anyone has information or has experience on the matter PLEASE comment.

    Usually, only retailers use the NTD... but I have heard of some other folks including it in background checks... but not very many.

    We cannot tell you if company "A" will do it or not.
