Question How Much Trouble Are We in

My question involves criminal law for the state of: Michigan.

My boyfriend and I were caught stealing from a store. We were arrested, taken to the police station and fingerprinted. Then sent home. We were caught with about $90 worth of merchandise. He had a previous record of disturbing the peace. I have never had so much as a ticket. We just made a bad decision and we got caught. And truthfully, we learned, it was the scariest thing I've ever done in my life. I had someone elses bank card in my bag, I had picked it up from the ground and put it in the small pocket of my purse that isn't used often and just forgot about it. Though, I understand how that looks to the cops and the law, someone caught stealing and has someone else's bank card.

The cop said that I would be charged with credit card fraud if it is called in as stolen and/or has any charges on it. Today is the third day since the incident and so far I have not heard anything from the cops, store, bank, nothing. I don't know what to expect to happen or how much trouble to plan to be in? Any help or advice would be appreciated.

    Thank you.

    It depends.

    Did you use that card?

    No.
Truthfully when I picked it up I had every intention of taking it to the bank, but I was watching my nephew at the time, so I put it in the small pocket of my purse so I wouldn't lose it. Then I ended up forgetting about it. Which I know sounds, and looks bad. I'm 100% confident that there are no charges on there that I made. But like the officer said, if it was already stolen and then just dumped near my house, I picked it up and then got caught with it.... it's on me then, right?

    Default This Time

This is from Michigan and it is reposted -- did not get answered before.

I had someone elses bank card in my bag, I had picked it up from the ground and put it in the small pocket of my purse that isn't used often and just forgot about it. I did not use this card and I am 100% sure there are no purchases from me on the card. (But, card could have already been stolen when I picked it up. Have not heard from cops, bank, lawyers... so assuming it wasn't.) Though, I understand how that looks to the cops and the law, someone caught stealing and has someone else's bank card.

The cop said that I would be charged with credit card fraud if it is called in as stolen and/or has any charges on it. Today is one week since the incident and so far I have not heard anything from the cops, store, bank, nothing. I don't know what to expect to happen or how much trouble to plan to be in for me or my boyfriend? Any help or advice would be appreciated.

PLEASE HELP ME THIS TIME! I'm still very scared and the more time goes by without hearing from anyone the more scared I get.

    Thank you.

You both should get a consultation with a Criminal Defense Attorney. As your boyfriend has a prior charge on record, and you were in possession of a credit card that was not yours.
