    Default I Am Locked Out of a Shared Easement

    My question involves real estate located in the State of: California county of Tehama.

    I have been bearing and enduring the pain of people stealing from me and locking me out of my home and ranch, where I have resided for almost forty years.

    I had surgery and my horses were stolen and sold in five days.
    When I got them back my neighbor who was responsible for having them impounded by animal control, even though there was secure fence, locked the gate to our properties.

    Under Sheriff lies to my face and tells me he sent my court order to the road was sent to County Legal, and he has not heard from them, in over 30 days.

    11-17-2009 I called County Legal myself after yet another call to Under Sheriff, that was unsucessful.

    The lady who answered the phone at County Legal said for me to ask the Under Sheriff which attorney he sent my paper work to and

    what office, because they do not deal with civilian issues. She told me it was impossible for the sheriff to bring my issue to them.

    I called Under Sheriff back, told him what County legal said, and he insisted he sent it to County Legal, so I called County Legal back .

    I told County Legal what Under Sheriff said the court order and it was at County Legal. He said he would get back to me after calling them.

    Secretary at County Legal transferred me to one of their Attorney's , before telling me they never had my papers.

    She said "I see everything that comes in here and there has been nothing with your name on it.", and we do not handle this type of issue, only if the sheriff is being sued.

    I spoke to this County Attorney and he said "The sheriff does not know how to enforce this court order".

    I replied why don't you ask the Judge who made the order?

    I also told him there are laws against interferring with a persons Documented easement to their property.

    County Attorney became extremely rude and said "You need to hire an attorney and find out how to enforce this court

    order", Because the sheriff does not know how to enforce it."

    Since when does an attorney need to tell the sheriff how to enfoce a court order?

    I am a widow who is bound to a wheel chair and limited income, why does the sheriff treat me with such dis-respect.

    I am not a criminal and a law abiding citizen and my property rights are being abused.
    No one in my county seems to care, I have used this road for twenty years.

    If you have a court order that is being violated by the defendant, you or your lawyer can seek enforcement through the court that issued the order. Talk to the lawyer who helped you obtain the order or explore these resources.
