The credit card was opened by my wife while we were married. I never signed anything for the account, although I could charge to the card too, and did. The divorce settlement required her to pay off the credit card debt.
I wasn't served with any papers, only my ex-wife was, about a month ago at her house. I only found out about it by checking the State Court Records. I think the collection agency believes we are still married, which it states in the complaint. So maybe they think they didn't need to serve me too?
I'm not sure if there was a judgement, but I see the 20 days have passed for my ex-wife to respond, and an Order Setting Civil Case Schedule was mailed to her. Perhaps that is a default judgement. It listed her name followed by et al., and the complaint listed my name too.
Thanks for responding to my question.
I am wondering if I need to hire a lawyer and respond to the order, or if I should just wait until they officially notify or summon me.
Brad
