    Default I Had Asylum and Left the U.S. Without a Re-Entry Permit

    I was conviceted of a 1st degree felony/non violent/white collar crime in 2003. I was sentenced to 5Yrs prison and 5 yrs probation. I had political assylum. I am a Haitian Citizen but I am French Decent 100% by blood. I was not deported after my sentence and was never in deportation. I filed for adjustment of status after my release from prison and it was denied due to my conviction. However, I was never given the oportunity to file for a waiver of any sort (I am HIV+). I got really scared that they would come and get me in the middle of the night and I swore that I would not ever let myself get into any position of being held or detained for any reason. I went to the Criminal court and had my probation converted to Administrative Probation and was granted permission to leave the USA. I am doing everything LEGAL so I have no more problems. I filed a an appeal and a waiver with immigration because I believe that I should have been granted the permanent residency, then I left the USA and went to the Dominican Republic to wait things out.

    I would like to know if it is possible to get a tourist Visa so I can see my famiily from time to time. I have re-established my simple life here and have no intentions of living in the USA anymore.

    Is it possible to get a tourist VISA? Please advise. THANK YOU!!

    It's possible to apply for a tourist visa. I would expect your application to be denied based upon your conviction of a serious crime of moral turpitude, but I'm not the one who will be making that determination. The HIV issue will soon be a non-issue.
