    Exclamation Child Support and Visitation

    My case is in FL.

I recently changed jobs, so my child support is late. My boss contacted the payroll company to have them send the support payment, but they stated that they couldn't until they received the paperwork from the DOR instructing them on the specific amount, etc. Since I started in the middle of a pay period, but pay was scant so I will have to wait until at least next week to make a payment.

My ex e-mails me and says that because I am behind on my child support, she cannot afford to drive our son to our regular halfway point for visitation and that I will need to drive to her house to come pick him up. I can't afford the gas for this either and I work two hours from where she lives. I can't take off work any earlier either...

This seems to me that it would fall under her almost refusing visitation by making it difficult for me to pick our son up on time based upon the lack of payment of child support which I know is illegal under FL law.

What should I do about this?

I would go pick him up, then when she wants him back, tell her to come get him. Most states say each parent must provide one way or the other. Your paperwork may state something about it.

And when she says no I'm not going to pick him up, you need to bring him down here? We keep him overnight and the cops are called?
This person is a vindictive snake of a mother and doesn't care what she puts anyone including our son through in order to cause me some kind of inconvenience...I jsut don't know what to do about this same crap that she pulls ALL THE TIME and our son isn't even 3 yet...

Unless your ex has already established a pattern of denying visits, it's best to just leave this one time alone. Especially when the law requires you to pay the CS on your own until the garnishment begins. Basically, you have a valid complaint, but so does your ex.

If neither of you have the money to work the visit as normal, maybe you should consider skipping this visit, and make your visit over the phone instead.
