    Post What Type of Time Will Be Served

    My husband was recently arrested and charged with 2 counts of Burglary of a vehicle. They listed them both as Class B Misdemeanors. According to the Texas Penal Code the sentence is confinement not to exceed 180 days (6 Months). He has a prior criminal record with similar charges. Will that effect this case right now? Will he serve 6 months total for both offenses, or a total of a year for both? Where would this time be served?

    He needs to check with his lawyer to see if he's likely to get consecutive or concurrent sentencing. Generally, sentences under a year are spent in a jail.

    They could enhance it to a state jail felony (6 months to 2 years) if he has felonies on his record.
