    Default Daughter Shoplifting in Oklahoma

    My question involves criminal law for the state of: Oklahoma

    My 19 year old daughter shoplifted at a well known chain. She was caught along with her friend and was not taken to jail. She was distressed by the security guards at this chain and was not allowed to use the restroom which resulted in accident that could have been prevented. I am in no way justifying what she did, she did something very wrong and she does know that. My question I have never had to deal with anything like this and have no idea what to do. She cannot afford an attorney, she works for a fast food restaurant. Can they appoint her an attorney at her court hearing? Or will they go off of mine and my husbands income as well, she does live with us still? Also I have been told she needs to plea no contest but after reading up on that it looks like she will be charged and sentence at that time and not allowed to get an attorney after that plea. Maybe I am understanding it wrong. Like i was saying I have no idea how the law works and am completely lost at how to help her with all of this. My husband and I have no way of paying for an attorney. We are on a budget as well. Any help will be greatly appericated.

    There is not much you can do but offer financial or emotional support to your daughter.

    Yes they can

    If she is an adult then the answer is no.

    She should plead not guilty and ask for a public defender

    Maybe I am understanding it wrong. Like i was saying I have no idea how the law works and am completely lost at how to help her with all of this.

    Just make sure she follows all her court dates and calls the restitution company to work out a payment plan for civil demand.

    My husband and I have no way of paying for an attorney. We are on a budget as well. Any help will be greatly appericated.

    If you cannot afford one, one will be appointed for you.

    We paid the company what they asked already for restitution. Should i print off the canceled check and take that with us to her court date?

    One more question. I have been reading some of the stickies at the top of this forum. I was wondering if she should plead not guilty ask for a public defender and then try to get the pre-trial diversion? Or should she call the district attorney and ask about the program before court in 3 days?

    I can answer your first question:

    Yes, take the cancelled check to court. The judge does like to see the Civil Demand has been paid. If you also have a copy of the letter, that that too, with the cancelled check stapled to it. That proves it is paid in full.
