    Question Criminal Charges for Fraud and Theft of Estate Property

    My question involves criminal law for the state of: Wisconsin
    I am the Special Administrator for my father's estate having been appointed by the Will and subsequently by the Court.
    I have learned that my brother, his wife, and her son de-frauded my father and the estate out of money and property. How do I go about pressing criminal charges against them?

    You go to the police and make a report.

    Have you filed a motion with the court to have the misappropriated assets restored to the estate?

    If your father gave items to your brother before he died, and he was competent to do so, then what ever he may have given will remain with your brother. If you brother borrowed money from your father and there is a record of it, then your brother will still owe the money to the estate and it can be deducted from the amount (if any) he receives from the estate. Your idea of fraud may be different than what the law's idea about fraud is. Maybe you can be more specific as to how you believe he defrauded the estate.
