    Default Rape Threat at Workplace

    I apologize if this is the wrong section so mods feel free to move.

    My girlfriend's friend/co-worker has been e-mailed by another male worker threatening her of rape. The e-mail says things like "I'm eventually gonna f*#k you!" and other things like that. This is not the first time. He stalks her and knows where she lives, calls her cell phone..etc..etc. She is scared and has nowhere else to go to. She told her boss/manager about it and he does nothing whatsoever. The manager just doesn't really care to be honest. The main problem here is that she is not a legal citizen of the U.S. so she is afraid to call the police. Is there anything she can legally do to protect herself without being deported?

    This is in California.

    Being of illegal status and afraid to have police contact severely limits what she can realistically expect.

    She could go to court and ask for a restraining order, BUT since that order would prevent the other employee from attending work, it may result in her employer letting HER go and KEEPING the other employee. And, if she's not willing to call police even if the order is violated, there's really no point to getting such an order in the first place. Such an order really only has any impact IF it is violated, and IF police can document the violation. (And if the accused employee gets irked that she's trying to get the restraining order, there's nothing keeping THEM from turning her in either.)

    On the other side of the coin, unless there's an active deportation order or other flag on her, police typically don't care what someone's immigration status is in the course of responding to typical calls. However, she'll have to be willing to take that risk if she wants to address the situation.
