    In the State of Washington, you are not required to pay court costs up front for a traffic ticket. These costs are "built-in" to the fine that you would pay if you were to lose the hearing. Thus, you have absolutely nothing to lose by choosing to contest the ticket.

    GOOD information I have an additional question. Just received a ticket for driving in car pool lane. There were some reasons I wanted to explain so asked for mitigation. Received notice and one sheet in pack is a form for agreed deferral of traffic infraction if not had one in last 7 years. I had another one a while back but cannot remember how long ago. If I fill out form and pay then it is found that I am not eligible, is there a penalty or just acknowledgement and loss of deferral?

    This seems like so long ago, but hopefully this information is still valid. I have a question though, am I mailing the discovery request to the court specifically? Or to the prosecutor? If so, how do I go about obtaining an address? Thank you Barry for your thoughtful work!

    The address is on your citation itself.

    Hi,

    I posted a more specific question in another forum but there was no answer. So I’m hoping I can at least get a response about clarifying related to the guide Barry posted.

    My question involves a traffic ticket from the state of: Washington

    1. The guide doesn’t mention serving by fax. If I fax the discovery request (to court and prosecutor), from what I’ve researched, it seems it’s considered served on transmission. But if I get to court and prosecutor says they didn’t receive it do I need to bring proof and what would that be?

    2. Re: the hearing. Should I expect it to be clear when I can state that I want to surpress due to lack of discovery and request for dismissal before prosecutor starts? If I ask for this and for some reason it’s denied, can I still request deferral? i.e. at what point is my deferral request no longer possible?

    update, i did it online. Very easy, Clark County though.
