I have question about the discovery template. Am I supposed to print it with the vertical slashes at the top and the numbers on the left? I've tried to get rid of the line numbers but I can't. Thanks

You should leave EVERYTHING THAT ISN'T RED in place.

After receiving a number of complaints from folks who have difficulty downloading the Discovery Request, here is the new link. You can download it by clicking on FILE => DOWNLOAD (in the toolbar in the upper left).

I have also place a copy of the Total Penalty Schedule for WA state courts. These amounts include all of the statutory assessments. You can see how much these amounts differ from the base fines specified in IRLJ 6.2.

    Quick question(s) for Barry:
I'm set to appear on Sept 17 2012 in Monroe for a ticket (speeding) received on June 28th 2012. I pleaded Not Guilty by mail immediately and received court date information which was postmarked July 23. Maxima culpa mea, I did not file for discovery with 14 days of court date (wish I'd discovered your excellent guidelines earlier). I would gather that it would do me no good to file, now correct?
    that's the first question...

Q2: Can I request to have the court date postponed, citing an appropriate reason? If yes, can I then file for discovery in advance of the new date?
Q3: If no, and I have to appear in Sept 17, do you have any suggestions as to how I might request a plea bargain to ask for non-moving violation (keen not to have insurance know about this; they do raise rates)? Please note that in April of 2009, I was granted a deferral by Judge Lyon for a similar incident (that having been my first and only infraction since moving to WA in 1995). I note in reading your guide that I should be beyond the 2 year window in which a deferral can be "reversed" i.e. a second infraction results in having to pay both fines.

Many thanks in advance and congratulations for the excellent and helpful advise you have been providing.

Q1 prosecutors will sometimes send discovery even outside of the 14 day rule, personal experience.
    Q2 Yes, personal experience

You need to start your own thread. That has been stated repeatedly.

Is discovery reciprocal??? Do I have to provide the prosecutor with copies of papers I intend to present at the hearing??? RULE IRLJ 3.1 (b) lists discovery I am entitled to then says " No other discovery shal be required?"

Can someone Amend this thread or point me to a how-to to appeal a decision in a contested hearing in WA?
