The immigration office has said that they are planning to deport my father at his hearing next week. How is this possible!?
My father has been in the U.S. for the last 30 years and been married to my mother for the same time period. He was found guilty of a felony (having a concealed weapon with no permit) 15 years ago. He recently got flagged by the Immigration office while flying back from Mexico. At that time, they took his green card and set up a hearing date. We are told that we will have two options ... 1) he will get deported immediately at the hearing or 2) he can appeal and be incarcerated throughout that process. I am in shock, and disgusted, as to how swiftly and without any questions the Immigration office is able to deport my father.
My parents have 4 daughters and 1 son and my mom is a stay-at-home wife. Is there a case to argue he can not be removed since he is the bread earner? He has no other criminal complaints (not even a speeding ticket) other then this unfortunate felony. What are our options?
