    Default First Time Offense Retail Fraud

    My question involves criminal law for the state of: Michigan

    last week i was caught trying to steal 2 packages of golf balls from walmart, estimated $50. i did not leave the store, and was heading to grab a cart as i had legitimate shopping to do, when i was confronted by walmart security. i told them i was feeling guilty and scared prior to the confrontation, and that i was planning on putting them back. they took all my info, photocopied my license, and put it all in a folder, and then told me about the civil demand part, where i have to pay walmart $200 for the crime. then, when a deputy showed up he told me that he was not going to take me to jail, and he just wrote me a citation for retail fraud, and under the charge description he put "mild". i am to call the court by 11/21/09 to schedule a pre trial. i am 17 years old and prior to this i have a perfectly clean record. my dad is a firefighter also, if that could help at all. i'm wondering what would be in my best interest, as well as any punishments i could face.

    You're in Michigan, so at 17 you're charged as an adult. You may be eligible for a deferral under a county program or, if that fails, under Michigan's HYTA law (search the forum for information about HYTA, or ask a local criminal defense lawyer to explain it to you).
