    Default Ex-Wife is Now Filing Bankruptcy

    My ex wife is now filing bankruptcy, if you read my previous post she has not paid the mortgage in over 6 months and voluntarily surrendered her leased truck, both having my name on the mortgage and lease. I am seeking legal help this week, my question is that she is in clear contempt of our divorce decree however what will the court do to rectify the problem. She will say that she does not have the money although she is driving around in a new BMW. If I was the person in contempt, the judge would tell me to find a second job to pay my debts with her.

    We can't predict how a court will rule, as we don't know anything about her employment situation or finances (save that most people filing bankruptcy don't have much money). You will have financial recourse through the divorce court after the bankruptcy, as her obligations to you under the property settlement are not dischargeable.

    Court date is this Friday. My ex-wife did go through with a chapter 7 bankruptcy and had the pending foreclosure of the marital home discharged although the PSA states that she is fully responsible for it. It should be interesting.

    Please keep us posted. My husband is now about to go through almost the same thing.
    we are in Michigan and last year when his divorce was final his ex got the house, the harley and the equity loan. It states in their dovorce decree that he is not responsible for them. It also states that she can not be more than 60 days late or he can put the house up for sale....what a joke. It also states that he has to work with her during a remodifictaon, which she has attempted 3 times and was denied due to financials, which is why the house has not been up for sale. Anyway, we were notified that the sheriff sale is April 9th and thsi weekend we just received a letter saying she filed for bankruptcy March 25th, 2010. Now where does he stand, the divorcee decree states he's not responsible but his name is still on the loans???
