    Default Lost Passport with H1b and I-797b

    Hello,

    I lost my passport along with my H1B and notice of action I-797B before I entered the US.
    I reported the loss to the police and applied for a new passport.

    I received my passport yesterday and will have a new appointment at the US consulate (in Toronto)
    for restamping in 10 days. Since I don't have the original I-797B (since I lost it), can I present a photocopy of it?

    Having lost the original, you don't have much choice but to try to use a copy. Consulate policies vary as to whether and when they will accept a copy.

    Do you have your latest H1 approval? If so, take it with you.

    Devan - I'm sorry to hear that you lost your documents. I would suggest that you also have the police report with you, evidencing that you notified the authorities of the lost document.
    Also, you may want to check with the petitioning company (the U.S. employer) to see if they have a duplicate original of the I797. If you had a lawyer representing you, he or she can also request a duplicate original, but that may take some time to receive from the government.

    Thank you Mr. Knowitall and RenataCaleraro for your answers.

    So a quick summary. 3 months ago, I went to the US consulate
    of Toronto to have my visa stamping for my H1. Then when
    my passport was mailed back to me it was lost in the mail (along
    with my H1 visa and my original notice of action I797B).

    I applied for a new passport and today I had my visa interview
    for restamping (I took with me my passport, DS-156, DS-157, photocopy
    of I797B, $131 scotia bank deposit slip and other things which were not required).

    It went pretty smoothly. I was worried that they would
    require the original of the notice of action I797B but I just explained them
    the problem and they accepted a photocopy of it (I didn't even have to show them the police
    report).

    Things went pretty quickly and the lady there said that I
    was the second person today who told her my passport got
    lost in the mail. Then she kindly offered me to pick up my passport
    at the consulate in person in 4 days so I won't lose my passport
    in the mail again.
