Default Unfairly Treated Based on False Allegations

My question involves labor and employment law for the state of: NM

A criminal investigation concluded without any charges being pressed. The employee investigated is employed with a family member of the alleged victim. This family member took it upon himself to take the matter into the workplace. The ramifications have affected the employee professionally to such a degree that he has been moved and has missed out on professional opportunities. I would like to stress that proper channels were not taken. Because there are no charges pending, and there seem to be no charges pending in the foreseeable future, has this employee been slandered or wronged in anyway by the family memberís actions?
