    Default I-130 and AOS

    My parents are in the USA on a 10yr multiple entry visitors visa. I want to know if apply for them( the I-130 and AOS) and the time runs over their stay(which is 6months)can they stay in the USA untill they recieve their greencards?

    That depends.

    Are you a citizen or are you a permanent resident? Procedures are different for each.

    Good! That means that as long as your folks came here legally - and they did - they can stay here while waiting for their paperwork to process. (Immediate relatives of LPRs have to wait in their homeland, sometimes for years.)

    I ask because I read on a forum that if someone comes to america to visit and changes that for AOS ,that this could be problematic ,that the person intended to immigrate. Would this be an issue ..Thanks for your help "law researcher missy"
