    Default Wacko Ex Wants Shared Custody

    State of CALIFORNIA

    I have a 3 month old child with a wacko ex

    Hes been abusive to me verbally and attempted phsyical (actually had his MOM hit me when i was 7 months pregnant)

    hes threatened me and abused me in front of my kids and family and throughout my pregnancy.

    Calif law states (i believe fam code 3044) that if he has perpetrated domestic violence he shall not be granted any custody rights to the child. (police reports filed for the violence....hell hes also RAN my credit without my permission recently -report filed for that also) What do i need to provide to the judge to show the evidence?

    Ive got plenty of witnesses and evidence from emails phone calls text messages ect where this guy has called me every vulgar name you can imagine along with threatening to kick my ass....he has struck at me but never physically hit me (had his mom do it for him)

    He has never seen the child, nor made any effort to. But now wants custody (50/50 one werek on/off and shes 3 months) hes never provided any support...called her a bastard child and wants nothing to do with her (i have it in writing)

    Hes also got LARGE snakes that could kill an adult...that are a threat to my child. Hes also addicted to drugs.....he has to live huis "lavish" lifestyle..

    This guy is 30 years old, living at home.

    I believe hes doing it for revenge since i cheated on him and went back to my ex husband.

    What should i expect? How do i get a child custody evaluator?

    Anyone know any good family law lawyers willing to do limited scope representation? I cant afford much im low income. Im in Santa Barbara county.

    Have you ever tried to get a protective order?

    What happened when the police came for the DV?

    Unless you have some very strong proof that he will present a danger to his child, you can expect that the court will order at the least some visitation. You could possibly ask for supervised visits, but again you will need alot of proof.

    Have you gotten a consult with a local attorney?
    If not, you should do so ASAP. Take copies of all of the police reports, etc with you. A local attorney will be able to let you know what to expect in court.

    There is a protective order in place. Police wouldnt take reports on verbal abuse since it wasnt physical abuse.

    I dont mind him getting visitation if he cleans him self up and gets treatment for his anger and drug useage.
