    Unhappy Hit By Another Car While Uninsured

    I was recently in a car accident and did not have insurance. I was hit from behind by a guy not paying attention. My car is not operational and i don't know what to do. Nobody has contacted me and i am having some serious back pain. I am going to the doctor today. I told the officer that i didn't have insurance because it had lapsed and he told me that the other guys insurance would take care of everything. Is this true? what do i do?

    Insurance protects you if you are involved in an accident and it is your fault. It also protects you if you get in an accident and it is the other driver's fault and the other driver doesn't have insurance.
    If you get in an accident and it is the other driver's fault, the fact that you don't have any insurance doesn't mean the other guy gets off the hook. The negligent driver is still responsible and his/her insurance should still pay up.
    The fact that no attorney is willing to take your case on a contingency fee either means that you were at fault or that the circumstances make it look like you were at fault.
    While most attorneys that represent plaintiffs are caring people, they do have to run a business. If they take cases on contingency that don't pay off, not only will the lawyer be out of work, but the lawyer's office staff will also lose their jobs.
    Sometimes lawyers have to make business decisions that make it seem like they don't care. The fact is, in our society, any business has to look at the bottom line.

    Thanks! I have not talked to an attorney yet though. This is my first accident and i am really at a loss as to how this whole thing works. The police report i got today clearly states that the driver was driving too fast for the conditions. I was stopped at a red light and had just started to move because the light had turned green. When i took my foot off the brake i heard his tires screech as he was coming down the hill and he hit me from behind. Like i said, i don't know how this whole thing works or even if an atty is needed.

    I know in ca if you dont have ins & its not your fault the at fault ins co will not pay for pain & suffering. They have to pay the property & medical bills.

    I am in the same situation with an accident that happened in NJ. Their ins co. claimed fault, but they only had $5,000. property damage coverage. They awarded that, but my car damage is over $12,000.

    Contact the ins. company they have listed on the police report. They will not contact you unless you file a claim!!!! If it is only a code, call the police dept, and request the name of the insurance comapny. File a claim for the property damage to your car. They will give a claim # and begin investigating. They are required to pay property damages if their insured was at fault, regardless of your ins. status ! Fax them the police report, and make a claim. Is your car at a body shop? If not go and get an estimate on damages, then refer the ins. co to the body shop. If they deny the claim, and you truly were not at fault refer to your states insurance commisioner and ask for an investigation.

    Also if your ins. was lapsed and now renewed conact your insurance company and get a letter stating that you had no auto ins. at the time of the accidenet, that way your own medical insurance will pay for any medical needs. At the very least you will have your car repaired, and you can use your medical insurance to cover any injuries. Hope this helps ! Deep breaths
