My question involves an eviction in the state of: New Jersey
My husband and I have a dilemma. Two years ago, we choose to leave our lovely little home in Ocean City, New Jersey to pursue a charter yacht business in the British Virgin Islands. A friend of my husbands had just lost his girlfriend to cancer, and at the time was living with her. We asked him if he would like to live in our home for a very cheap rent ($800.00/mth.) in exchange for caring for our two small dogs, a Bischon and a Westie. He jumped at the opportunity. We drew up a standard lease at that time which expired in June of 2009. He lost his job a month after moving in. We received rent at various times of the month, found out our water was turned off several times (our credit in question), and finally he advised us that he couldn't pay rent any longer (I believe that was in April). We said fine, just pay the utilities. (I returned home in February to put the Bischon down.) He had one dog to look after from February to June. We returned home in June. He lived with us and began a seasonal job in Atlantic City. He did pay us $500.00 a month at that time. The list of things we did for him goes on and on, but I know that will all mean nothing now. We are now back in the British Virgin Islands. The Westie is with someone else. He is paying no rent, there is no lease. He was asked to pay utilities - on time please. We have made numerous calls to him from BVI and sent many emails asking various questions regarding maintenance we've arranged on the home, etc. He is ignoring us. It's been well over a month now. Also, he is in our home without a lease during this time. What mess are we facing to get him out of our home. Appreciate your legal expertise.
