    Default Can Custodial Parent Limit Non-Custodial Parents Visits Based on the Childs Age

    My question involves a child custody case from the State of: Texas

    My daughter is 2 yrs old, I stay home with her. Her father and I are talking about separating. I don't feel comfortable with him keeping her over night, much less entire weekends. There are 2 reasons for this, she's very attached to me, also I don't trust his 13 yr old daughter who lives with him. Will these reasons hold up in court?

    These are not legal reasons.

    Do you have a documented reason for not wanting the 13 year old around the toddler?

    If he asks for 50% custody he can probably get it.
