My question involves a speeding ticket from the State of: California
Hello,
I'm sure that a lot of the people here who come looking for an easy way out and don't provide a lot of info expecting you to do the work. I'll try to provide as much detail as possible, and any help would be appreciated.
Late Sunday night I was driving home on the 101 with a bunch of friends. There were 4 lanes each way, and not a car to be seen. Out of the blue, I see a cop pull up behind me and turn on his siren. I pull off the highway on to a well light street just next to the onramp, turn off my car, roll down the windows, turn on my inside light, place my keys on top of my car and wait. (This is overkill for what I am REQUIRED to do, but I try my best to be polite to officers, especially when they're pulling me over).
My friends were cramped into the car, but completely legally so (everyone had a seatbelt and was wearing it properly). The officer came up and asked me if I knew how fast I was going. I said yes, I believed I was going about 90 (knowing that in this case trying to bluff my way out wasn't going to work). He said close, it was actually 88, and then asked me for my license and registration. I told him it was in my bag in the trunk, but that I had a photo copy of it in my glove compartment. He took that and let me go look for my wallet. I was unable to find it, and told him so, and asked him if he would consider letting me off with a warning (I asked for a "B-boy instead of a C-Charlie." which a friend told me was well known amongst cops but clearly made me look REALLY stupid in front of them. I think this hurt my chances, I should have stopped at asking for a warning).
The ended up giving me the speeding ticket (looks like VC22349a) and wrote Speed Aprox 88 in a 65.
The ticket copy that I got is nearly illegable, but from what I can see, there may be a mistake or 2 written on it. I have 2 questions:
1) Where am I able to get a better copy of the ticket (such as what was put into the computer system by the officer).
2) If the officer write the wrong date or time, how much does it need to be off by for me to be dismissed (I have 4 witnesses who were certain to check the time we were pulled over).
3) what other errors written on the ticket could get me off? It looks like he wrote the wrong year of vehicle, and possibly a few other things (though as I said, it's practically illegable).
Is there any other advice you can give on this matter? I am well aware that my defense won't come from not speeding, but I also know that I was not going an "unsafe speed" on the highway (as I got back on, 5 cars passed me going closer to 100MPH. Though I don't think this will count for anything, as I was still speeding).
