    Default Probation Violation for Failure to Report

    I received an underage consumption in July of this year, went to court and was sentenced to 6 months supervised probation, 200 dollar fine and 20 hours community service.

    I met with my probation officer directly after the hearing, and set up another appointment. This is where the problem starts...

    I must have written down the wrong date for my appointment because in September I received a letter that I had missed an appointment, I tried to call the probation office daily to reach my probation officer but I was unable to (she was always in court, or out of the office). I am a full time college student on top of working a full time job, and I just do not have the time to sit around and wait for three or four hours to try to reach her again.

    This is my first time ever being in trouble for anything. I guess I did not understand how probation works, as it was briefy- very briefly- explained to me in my first meeting.

    I then received a summons in the mail to appear in court for a probation violation. I went to court, and I now have a public defender for another hearing set for December. I met with my probation officer immediatly after and apoligized for any confusion, but she would not dismiss the probation violation, nor was I asking her to. I understand that it is my responsibility. After meeting with her, I drew the conclusion from what she is telling me that if I have my fines paid, and community service done- which they are- I have a lower chance of facing an extreme punishment. I have also taken matters into my own hands to sign up for a drug and alcohol assesment through a STEPS program to prove not only that I do not have a problem, but my responsibility level. I am also having my boss at work write a letter to the judge describing my attendance history, which is beyond satisfactory.

    I guess what I am asking, is what do you think will happen to me with all of these steps taken? And if there is anything else I can do?

    I suggest that you do everything you can to complete your sentence and look to the court like a mature, responsible adult who made a mistake that won't be repeated. Put yourself in a position where the judge might consider reinstating probation, or even discharging you as having completed the sentence despite your violation, as opposed to thinking 'jail'. As for what's likely to happen based upon the facts as they (will) exist at the time of your (future) hearing, talk to your lawyer.
