    Question Ex-Boyfriend Wants to Adopt

    This is a question concerning adoption law in the state of Tennessee.

    I have a very good friend who was dating a young lady for about 18 months. She had a little girl who was 4 months old when they got together. They have since broken up, but my friend has continued visitation with the little girl. He gets her every weekend. The biological father hasn't been around or supported the little girl, but he has tried to see her a couple of times and the mother won't let him. He is currently under indictment for drug related charges. Now, my friend is wanting to adopt the little girl as his own even though he isn't with her mother anymore. The mother is telling him that it will be easy, but I have tried explaining to him that normal adoptions can be difficult, let alone ones with such strange circumstances. I also told him that the father's rights would either have to be signed over by the father or taken away by the court.

    Does he have a shot at being able to adopt this little girl at all or is he wasting time and energy by even contacting an attorney?

    My first thought was to tell you that there's no way that he will be able to adopt unless he is married to the mother, which is probably correct.

    However, I really don't know for sure, so he really should go ahead and get a consult with a local adoption attorney to see if it is possible or not. Consults are generally inexpenmsive and well worth the small cost.
