    Default Witness Against Boyfriend

    My question involves criminal law for the state of: NH

    My drunk boyfriend got arrested for criminal misconduct - vandalism after breaking my windsheild during an argument. He told the police and it's noted in the report that I threw something at him first which angered him to take it out on my windsheild. I did not get charged with anything but I am concerned. Can I get arrested for assault (?) battery after the fact or when appearing as a witness for the state just on his say so?

    I didn't call the police (even though someone else did after the incident). The police showed up and asked me what happened. I said he was drunk, we argued and he busted the windsheild. The police arrested him even though I told them I didn't want him to get arrested, didn't want to press any charges, he didn't hit or threaten me. etc.... and now, there is a protection order in place (that I never asked for) and do not want to testify against him but I am hearing that I may have to?

    Any advice would be greatly appreciated.

    Typical bf/gf stuff here. The police were called, they saw a crime was committed and they made the arrest of the person who did it. Honestly, the police could care less if you wanted him to be arrested or not. Once the police are called, it is mostly in their hands and they will arrest if they have cause. I take it you to live together and this happened at the residence? The protection order is normal protocol and honestly in a lot of places you can get it dismissed if you go talk to the DA and tell him and then you may have to see a judge. Once again though, why does everyone want to make excuses for someone being drunk. He made a stupid mistake and you know this, so he will face the music now. I doubt he will get anything more than probation and a fine, but it all depends on his record.
