    Default J1 Marriage

    I've read countless threads on the same topic. Any help would be greatly appreciated. J1 Visa holder without 2 year requirement. We will be married before the J1 Visa expires but I doubt the forms will be submitted before the Visa expires since I'm a terrible procrastinator. Is that OK? To get married before the visa expires and turn in the forms after it expires?

    Also, does anyone know how long the advanced parole form takes to process. We'd really like to travel to see her family for the holidays but I fear that it won't be processed in time.

    I didn't think to hire an immigration attorney at first but after printing the forms I think I have too many questions to do it on my own. Thanks in advance for the help.

    Between the time your J1 visa expires, and you finally get around to filing the adjustment of status forms, you will be considered out of status and subject to deportation. Simply being married to a US citizen will not stop that, you have to be in process of adjusting your status. I would hope that would be enough motivation to over come the procrastination!!

    You should file the petition and adjustment of status as soon as possible after the marriage.

    An immigration attorney definately could help the process, as some of the forms/processes are a bit complicated. You should read up on the process as much as possible before seeking advice so you can have a good idea of what is needed and specific questions ready.
