    Default Using a Security Deposit to Cover Rent

    i am moving out i gave landlord 30 day notice he says i owe back rent from last april. i told him the security deposit wil cover that he says no he wants money ...is this legal? live in new jersey

    Of course it's legal. Your security deposit is a security deposit, not a rent payment.

    He is entitled to collect the back rent from April, but then must disburse your deposit back in full.

    Otherwise, if the lease states so, he can keep the portion of your deposit to cover any back rent due + late fees, however you cannot tell him to do this.
