    Angry Notice of Intent to Vacate

    Florida--
    My landlord has threatened me with eviction...and I don't want that on my rental history.
    Can I send a Notice of Intent to Vacate to beat him to the punch?
    This guy opened my door and came in screaming and cursing at me. He scared me to death and I ended up filing a police report...I don't feel safe living there AT ALL. Would this be grounds to break the lease without penalties applying?
    The man was literally crazed...he's going through a divorce, his wife knocks on our door asking us about rent (saying her husband-our landlord-hasn't been paying the mortgage), we have been served with foreclosure papers confirming he has been taking our rent money which is WELL in excess of his mortgage payment and not paying the house...He doesn't return phone calls and when we are on the phone with him he always has to "call us right back" or he's "with a client" and needs to go...
    We are a few months behind and had told him MONTHS ago that we were having extreme financial difficulties...so he busts in the house the other day screaming...
    I have also requested a copy of the lease because we misplaced it and he stated that he could not find the original document and printed out a different lease with a lot of incorrect information (looks like from a template he has for his properties) and in the signature blocks he put "signatures on file". Does him not having the original or being able to provide us with a copy something he can get in trouble for? Should I ask for it again in writing?
    What are my options here?

    Having your landlord yell at you is not a basis to break your lease.

    There's no reason your landlord can't charge you rent in excess of his mortgage payment.

    If you don't pay your rent, your landlord can evict you.

    If you wish to move out early, discuss with your landlord whether or not he will release you - but I would expect that he'll pursue you for the rent you owe unless you pay it.

    You signed the lease? Then you signed the lease. And even if you did not, you would still owe rent at the agreed rate.
